Here’s How to Prevent Spectator Injuries this Summer https://www.simonlawgroupaz.com/hey-sports-fan-heres-how-to-prevent-spectator-injuries-this-summer/?utm_source=rss&utm_medium=rss&utm_campaign=hey-sports-fan-heres-how-to-prevent-spectator-injuries-this-summer Thu, 11 Jul 2019 15:30:10 +0000 http://www.simonlawgroupaz.com/?p=5506 Summer is a fun time to get outdoors and take in a game – whether cheering on Little League, or catching an Arizona Diamondback game, a soccer game, softball, golf or Frisbee. As a spectator, we love to watch our favorite athletes take on their competitors, and root for our home teams. But, even being a spectator comes with the risk of injury, and, this risk is assumed when you purchase your ticket and attend the sporting event.

What can you do to reduce the chance of injury to you, or your children? Here are 5 tips to keep you, and those around you safe:

Understand the risk

When you purchase a ticket and attend an event, you are agreeing to the fact that you are willingly participating in a dangerous activity. Most the time, this means that if you are injured, you aren’t able to sue the sporting venue, ownership, etc. However, there are some exceptions to this rule, and only speaking to an attorney about your case will clear it up.

If you are more vulnerable to injury because you have small children with you, or are limited in mobility, take extra precautions for safety such as choosing a safer seating area, such as in an enclosed area.

Stay alert

Texting or keeping your eyes on your cellphone isn’t a safe practice when there is a potential of an object flying towards you. Keep your eyes on the game and watch for projectiles.

Bring a glove

Most spectator injuries happen at baseball games, so be aware of where you are sitting (some areas are more prone to foul balls then others), and bring a glove to catch a baseball or softball before it collides with you, or nearby spectators.

Shout

If you see a projectile coming your way, shout for a ‘heads up’ or ‘duck’ for those who may not be paying attention.

Teach your kids

Teach your kids safe spectator practices, such as watching for objects, and how to protect their head, face and extremities from injuries from projectiles.

When Something Goes Wrong at a Sporting Event

Since there is a little chance of remedy if you are injured at a sporting event, it is better to take proactive steps to protect yourself. If you have been injured, it is still a good idea to contact a personal injury attorney to determine if your unique situation allows for compensation for your injuries, or for the injuries of a loved one.

Personal Injury and Property Damage Caused by an Impaired Driver? Know Your Rights https://www.simonlawgroupaz.com/personal-injury-and-property-damage-caused-by-an-impaired-driver-know-your-rights/?utm_source=rss&utm_medium=rss&utm_campaign=personal-injury-and-property-damage-caused-by-an-impaired-driver-know-your-rights Thu, 11 Jul 2019 15:27:59 +0000 http://www.simonlawgroupaz.com/?p=5505 When a person gets behind the wheel of a vehicle, it is their responsibility to be a safe and courteous driver who follows the laws of the road. When they are tired, distracted, or under the influence of drugs or alcohol which impacts their ability to drive, they put themselves and others at risk. It is negligent, and can even be criminal.

We’ve all made mistakes with driving – not seeing a vehicle in our blind spot, or stopping short, or not soon enough, because we misjudged distance. These are true accidents. But when someone chooses to drive impaired, and that action results in damage to property, and physical harm, the injured party has the right to be compensated for their loss.

Your Rights as an Injured Person

Many people who have experienced damages caused by an impaired driver assume that insurance will handle it, and in some cases, this is true. However, for others, the settlement the insurance company offers isn’t enough to cover the expenses, either now or in the future. When this happens, they will typically call a personal injury attorney to learn more about what they can ask the insurance company to pay for. Typically, injured parties are entitled to:

Property Damage. If you have damaged property, such as to the vehicle you were driving and significant items inside, or your landscaping or home (yes, impaired drivers have been known to damage homes), you can get compensation to repair or replace that property.

Medical Bills. Medical bills will begin to build up quickly, and can continue for a significant amount of time. The insurance company will offer a settlement that limits the amount of money they will pay out over the lifetime of the injury. Significant injuries can be life-changing, and future medical bills must be part of the equation.

Loss of Life/Loss of Quality of Life. When the accident results in death or dismemberment, the quality of life for the person and/or their family is severely impacted. This impact has several factors that need to be reviewed in order for compensation to be considered. While no amount of money will be a replacement for a life or lifetime disability, it will help the family transition into a “new normal”.

Lost Wages. Especially in a significant injury, it is likely there is a hospital stay, rehabilitation and follow up appointments, resulting in lost wages. Future lost wages can also be compensated when there is a permanent disability as a result of the accident.

Pain and Suffering. While more objective than tangible doctor bills, some cases allow an awarding of compensation for pain and suffering for both the injured party and their family members who become care takers or have suffered a loss from the accident as well.

Because there are several factors that go into what can be compensated, and at what levels, working with a personal injury attorney is critical to obtaining a result that is truly supportive of your needs, not just what the insurance company wants to offer to protect themselves.

Simon Law Group offers a free consultation to help those injured, or the family of the injured person, to find justice and receive compensation when there has been an accident or even death.

Recently in the news there have been some accidents that could be grounds for a case. By taking a look at them, you may understand more about what types of cases should be talked about with a personal injury attorney.

Examples of Potential Personal Injury Cases in Recent News

Recently, two stories made the news in Phoenix, both of which could warrant a case:

Pedestrian Struck by Vehicle.

Man struck, killed by vehicle in north Phoenix (Source: AZFamily.com)

In this first story, the man stuck was a pedestrian, and the driver didn’t seem to be impaired, or speeding. This was a tragic accident and the family of the deceased pedestrian may have a case. In order to truly understand their rights, they should contact a personal injury attorney.

Woman Killed in Vehicle Collision

Woman killed following collision in Phoenix (Source: 3TV/CBS 5)

This story involves a driver who failed to yield to oncoming traffic, resulting in an accident that killed the driver, and injured two others, one who was the passenger. Neither of the two injured parties were at fault, and therefore could receive compensation for their medical bills, property damage, and pain and suffering (in some cases).

Do Passengers in an Auto Accident Have Rights? https://www.simonlawgroupaz.com/do-passengers-in-an-auto-accident-have-rights/?utm_source=rss&utm_medium=rss&utm_campaign=do-passengers-in-an-auto-accident-have-rights Mon, 29 Apr 2019 19:56:53 +0000 http://www.simonlawgroupaz.com/?p=5446 ]]> You weren’t driving, but you have been hurt – can you have your own case or do you need to take what the driver’s insurance offers you? When a passenger in a vehicle has been hurt, they often don’t know or understand their rights when they’ve been injured. Who is responsible to cover medical bills for their injuries? Are they eligible for compensation for pain and suffering?

What Are My Rights as a Passenger in an Accident?

Situations can be very different from case to case on accidents with injuries. But, because a passenger is not the reason for the accidents, they are entitled to compensation. In most accidents, the injured party can receive money for property damage, medical expenses, pain and suffering and loss of income. This all still applies as a passenger of a vehicle, even when you don’t own it.

Property damage includes damage to the vehicle, but also other personal property. If you lost personal property as a result of the accident, you may be able to receive compensation for that loss.

Medical expenses include transportation to a hospital, medical treatment and care, after care such as rehabilitation or physical therapy, and needed medical equipment. Depending on the severity of your injuries, you may have injuries that last for years to come, and the care of that can also have compensation attached. It is important to talk to a lawyer about what exactly can be awarded.

Pain and suffering includes the emotional toll the accident has had on you and sometimes even your family members. If a loved one requires leaving work to care for you, or you aren’t able to provide or be intimate as you once were, pain and suffering compensation is designed to “make up for” that.

Loss of income includes wages for time out of work due to your injuries. This can include an initial hospital stay, and even follow up appointments to the doctor. For significant injuries that impact your ability to make income at your current career, additional financial compensation may be awarded.

Other considerations may be available depending on your unique situation. It is important to get a free consultation from an injury attorney to determine what your award may be and the steps you need to take to get compensated for your loss.

Can’t Pay Your Medical Bills after an Accident? Let’s Talk About Your Rights https://www.simonlawgroupaz.com/cant-pay-your-medical-bills-after-an-accident-lets-talk-about-your-rights/?utm_source=rss&utm_medium=rss&utm_campaign=cant-pay-your-medical-bills-after-an-accident-lets-talk-about-your-rights Tue, 12 Feb 2019 17:45:24 +0000 http://www.simonlawgroupaz.com/?p=5439 ]]> They Take a Quick Insurance Settlement When your medical bills begin to come in, you may be tempted to accept an insurance company settlement in order to get them paid, but don’t make this mistake. Instead, contact an experienced personal injury attorney to determine if you have a case, or if the settlement being offered really is fair and sufficient. A fair settlement will cover current and future medical bills. Talk to an experienced lawyer who knows how to calculate future medical expenses. They Waive Their Rights When you accept the insurance company’s settlement, you waive your right for future compensation. For example, you may go to the chiropractor for several visits for whiplash, but months later you begin to feel the effects of a concussion. If you have already taken a settlement, the doctor care for the concussion will come out of your pocket. It’s important to wait on accepting a settlement until the full effects of the accident are known. A personal injury attorney understands how injuries can grow and what the proper compensation should be. All Damages Aren’t Considered In addition to medical expenses, there is also likely property damage. Sometimes replacing the car isn’t a viable option, and yet when a client is hasty, they may accept an insurance settlement that doesn’t allow them to repair or replace their vehicle. It is important to take into consideration all damages, including long term effects of the loss such as in lost wages, pain and suffering. Getting a free consultation from a personal injury accident lawyer as soon as you, or in some cases, on behalf of your loved one, as soon as possible. Their advice can save you from losing even more by giving up your rights to the compensation the law allows to restore you, as best as possible to the condition you were in prior to the accident. Simon Law Group would like to earn your trust as a local personal injury accident lawyer. Vehicle Versus Pedestrian: Arizona’s Scary Trend and What You Can Do About It https://www.simonlawgroupaz.com/vehicle-versus-pedestrian-arizonas-scary-trend-and-what-you-can-do-about-it/?utm_source=rss&utm_medium=rss&utm_campaign=vehicle-versus-pedestrian-arizonas-scary-trend-and-what-you-can-do-about-it Tue, 08 Jan 2019 18:20:40 +0000 http://www.simonlawgroupaz.com/?p=5424 ]]> th in the country for pedestrian deaths? More than 60 pedestrian fatalities had been reported as of September 2018 for the year. While Federal agencies are working to provide support through better vehicle testing and headlight systems, as pedestrians and drivers, we must also take a proactive approach to safety and halt and reverse this terrible trend. Safety Tips for Pedestrians Children aged 5-9 are the most at risk for pedestrian accidents. Other high-risk situations, such as high speed roads, roads with no sidewalks, need to be handled with care. Here are some steps to take to reduce your chance of being hit by a car.
 • Never run into the road. Always stop at the curb.
 • Look both ways before crossing the street. Watch for distracted drivers and use caution before entering the road or crosswalk.
 • Be alert and continue to watch for vehicles while crossing the road. Never assume you are safe until you have fully crossed.
 • Cross at intersections, whether or not there is a cross walk there. Avoid crossing in the middle of street.
 • If crossing to catch a bus, watch for traffic and the bus driver’s awareness. Walk 3-5 feet in front of the bus so the driver can see you cross in front.
 • Never go behind a bus or bend down to pick something up in front of or under a bus as the driver is not likely to see you – even for a second.
 • When walking at night and/or on roads without sidewalk, walk towards traffic so you are better seen. Consider carrying a light, and wearing bright or reflective clothing.
 • Always check for turning or traffic entering a sidewalk from a parking lot or alley.
 • Be alert around light rails and street cars. Follow the safety instructions and limit distractions that could put you in danger, such as looking at your phone while crossing tracks or the road.
Road Safety Tips for Drivers It is important to be aware of pedestrians when driving to prevent dangerous and even fatal collisions. Here is what you should do to limit your chances of colliding with a pedestrian:
 • Always use your blinker to communicate your intentions with others on the road.
 • Drive the speed limit. A pedestrian hit at 40mph has less than a 20% chance of survival.
 • Don’t be a distracted driver. Keep your eyes and attention on the road.
 • Show caution when you see pedestrians, especially if they are children or look impaired, confused, or unstable.
 • Honk an alert if you feel it creates more awareness and safety in the situation.
 • Always stop before the crosswalk or marked stop bar. Five feet before either communicates to the pedestrian they are safe to cross.
 • Look left, right, and left again before pulling through a crosswalk when pedestrians are present.
 • Always yield right of way to a pedestrian.
 • Be sensitive of visually impaired pedestrians – don’t honk or give directions.
 • Always expect children to be around stopped school buses and give them extra room for children to pass safely.
 • It is against the law to pass a school bus that is stopped and has its red lights flashing.
 • In school zones, slow your speed and do not pass other vehicles.
 • Avoid rushing out of driveways, parking lots or alleyways. Assume there is a pedestrian crossing. Slow down and look before crossing the sidewalk to the road.
 • Pedestrians have the right to walk on the road if no sidewalks exist. Use caution.
 • When in doubt, yield to pedestrians. This includes in parking lots, on the road and in intersections and roundabouts, whether or not a crosswalk exists.

How to Prevent a Dog Bite https://www.simonlawgroupaz.com/how-to-prevent-a-dog-bite/?utm_source=rss&utm_medium=rss&utm_campaign=how-to-prevent-a-dog-bite Tue, 08 Jan 2019 18:19:16 +0000 http://www.simonlawgroupaz.com/?p=5423 ]]> To Prevent Dog Bites Always ask permission before petting a dog you don’t know. The owner will know if the overall temperament of the dog will allow for this, as well as knowing if the dog is particularly agitated or stressed at the current moment. Trust the owner’s answer and don’t pet the dog if told not to. After you have permission, let the dog smell your hand. Place the back of your hand or your fist out for the dog to sniff. If they are wanting to be pet, they will move towards you. If not, they will look away or move away from you. Avoid touching an unknown dog who is eating, chewing, barking, growling or sleeping. Remember the size of the dog isn’t as important as their behavior – a large dog can be friendly and a small dog can be aggressive. Treat all unknown dogs as aggressive until you learn otherwise. Helping Your Dog Not Bite Have your dog spayed or neutered as this helps them be less likely to become aggressive and/or bite. Bring your dog to obedience classes to learn basic commands and create a structure for them to understand their role in your family. Socialize your dog by exposing him or her to situations with other dogs and different people. Walking your dog on a secure leash in public places is a great, safe way to start. Supervise your dog at all times. Be proactive with safety, such as ensuring there are not escapable holes in the fence, proper locks on gates, and good communication with visitors to the property who may come in contact with your dog. Post “Beware of Dog” signs as appropriate. Learn any “triggers” your dog has and seek the help of professional dog trainers for support when needed. Here’s what the ASPCA says: “Err on the safe side. Be aware of common triggers of aggression, including pain, injury or sickness, the approach of strangers or strange dogs, the approach of people in uniforms, costumes or unusual attire (especially hats), unexpected touching, unfamiliar places, crowds, and loud noises like thunder, wind, construction, fireworks and appliances.” Signs of an Aggressive Dog It is in a dog’s nature to charge a door, fence or other area they feel they are protecting. An aggressive dog, however, exhibits additional behaviors and signs to signify they are ready to defend themselves, their human(s), their babies, or their space. When a dog wants you to back off – for whatever reason, they will perk their ears up and the fur along their spine or butt may stand up. Think “stiff” – stiff legs, stiff tail as signs to back up and away from the dog. Baring their teeth and growling are also clear signs of aggression. If You Get in a Dangerous Situation with a Dog When in a scary situation with a dog, remain calm. Stay still to see if the dog retreats once they realize you are not a threat. Ignore the dog, watching him or her out of the corner of your eye rather than making eye contact, which is a sign of aggression. Back away slowly and leave the situation if possible. Never try to outrun a dog. If you are knocked down or fall down, curl up into a ball and cover your neck and ears with your hands. If you or a loved one have been bitten by a dog, you may be entitled to compensation for your injuries. What Happens When You’ve Been Injured by an 18-Wheeler https://www.simonlawgroupaz.com/what-happens-when-youve-been-injured-by-an-18-wheeler/?utm_source=rss&utm_medium=rss&utm_campaign=what-happens-when-youve-been-injured-by-an-18-wheeler Wed, 05 Dec 2018 18:19:40 +0000 http://www.simonlawgroupaz.com/?p=5411 ]]> Insurance Adjusters Are Experienced Insurance adjusters are skilled in protecting the assets of the company they represent. It is their job to find an agreeable compromise, and they have the experience to do so, unlike the injured party on the other side. They often will offer a settlement that will sound good to you, but is in their best interest, before yours. A consultation with a lawyer can help you determine if what you are being offered is sufficient for the scope of your injuries and loss, both physical and emotional. Specialized Requirements Exist Operators of 18-wheelers are required by law to have a specialized license, high levels of insurance, and follow specific regulations. Because of this, the accident includes more elements of liability than an accident with another passenger vehicle. It is important to speak to a personal injury lawyer about your case to determine your rights. Greater Risk Because of the shear size of semi-trucks, it is likely that damage, both to property and bodily injuries, are more significant than other accidents. Greater injuries and damages mean the need for greater compensation exists to adequately cover medical bills, loss of wages, property damages and more. When you have been involved in an automobile accident with a semi-truck, it is more than just another vehicle collision – it requires the support of an experienced law team on your side to fight for your rights against a large insurance company. Personal Injury Claims: What Makes Them Legitimate? https://www.simonlawgroupaz.com/personal-injury-claims-what-makes-them-legitimate/?utm_source=rss&utm_medium=rss&utm_campaign=personal-injury-claims-what-makes-them-legitimate Sun, 30 Sep 2018 21:32:13 +0000 http://www.simonlawgroupaz.com/?p=5401 ]]> What makes a personal injury lawsuit legitimate? In a personal injury case, the two main factors to consider are: Injuries and Responsibility (or Fault). Are There Injuries? If a person isn’t injured, there is no remedy. This may seem silly to state, but some people have felt that by simply finding a bug in their food (as an example), that they can sue. While a bug in your food may be gross, it is not a legitimate basis for a lawsuit. Injuries, however can include a number of definitions, which is why speaking to a personal injury lawyer is a good idea to gauge whether or not you have a legitimate case. Injuries can include physical, emotional pain and suffering (including that of family members), loss of wages, wrongful death and, in rare cases, punitive damages. Physical Injures include those which have caused pain such as broken bones, sprains, strains, bruising or lacerations, burns or physical symptoms that would not be present had the trauma not occurred. Emotional Injuries include experiencing PTSD or other psychological conditions as a result of the injury event. It can also include pain and suffering which is the effect of the loss on your emotional state, such as in the case of ongoing chronic pain. Loss of companionship is an emotional injury caused to your loved ones if you are significantly injured or incapacitated in a way that takes a toll on them. Loss of Wages includes both loss while recovering, as well as the impact on future wages if you will now be required to work a different career or have limited advancement opportunities due to your injuries. Wrongful Death is when the injured party’s family brings a lawsuit because the trauma resulted in death. Punitive Damages are awarded in Arizona on a limited basis. They are meant as a punishment to the party who caused the injury with malice and intention. Who is at Fault? In order for a personal injury lawsuit to be valid, someone other than the victim must be found to be responsible for the injuries through intent or negligence. Again, this may seem silly, but if an injury occurs because the victim hurt themselves, there is no basis for a lawsuit. Slip and Fall lawsuits require that the injured party have a reasonable expectation of safety and take proper precautions, AND the person or business was truly neglectful in their role in the injury. In order for the business to be responsible, they either needed to know there was a hazardous situation and didn’t remedy it, or they caused the unsafe situation. Motor Vehicle accidents involve discovering of who was at fault and to what degree. Often police reports, and investigations are conducted to find who is responsible for the injuries. Medical Malpractice is when a medical professional fails to provide an expected standard of care and this action or non-action results in injuries or death. Dog Bites injuries are often placed on the owner of the dog, but investigations will be conducted to determine if the victim bears any responsibility in the attack. Other Injuries will be looked at on an individual basis, however, if you have been injured because of someone else’s actions, it is best to contact a lawyer to determine if you have a legitimate personal injury case.
